A Benton couple accused of second-degree criminal abuse of their 2-month-old infant son appeared in Marshall County District Court on Monday.

The charges stem from an arrest made by the Kentucky State Police on Thursday morning.

The KSP arrested Shannon Boss, 21, and Andrea Wagers, 22, of Benton in connection with the incident.

The KSP was initially notified by the Marshall County Department of Community Based Services of possible criminal abuse involving the child.

According to the citation the initial report by the DCDS to the KSP came after the infant’s pediatrician noted multiple bruises on the child, as well as possible fractures on the clavicle and leg.

The incident injuring the child allegedly occurred on Nov. 15 at the couple’s Dunn Cemetery Road home in Benton.

Following the initial investigation, KSP and DCBS located the infant, who was receiving care for his injuries. KSP officials said the child was being treated for abrasions, possible fractures to the leg and clavicle and bruised eyes at an area hospital, but would not say where the child was being treated.

After locating the child, KSP made the arrests on Poplar Street in Murray – lodging the couple in the Calloway County Jail. Both were later transferred to the Marshall County Detention Center.

KSP charged Boss and Wagers with second-degree criminal abuse of a child 12 or under – a felony charge.

According to police Wagers and Boss admitted using drugs while caring for the infant.

Wagers told police the two were engaged in a physical altercation when the baby fell from Boss’ arms.

Boss told police during interviews he had been using drugs at the time of the incident, grabbed and squeezed the child and drove with the child in the car while under the influence.

Wagers and Boss are being held on $10,000 cash bond.

The investigation is continuing by Trooper Jody Cash.
