Ward plans to keep job despite Foust's request
Commonwealth Attorney issues apology for DUI arrest

BENTON In a letter sent to out to media outlets, government officials and law enforcement last week, Commonwealth Attorney Michael D. Ward, issued an apology following his recent arrest for driving under the influence.
The letter stated, “On Saturday night, Feb. 16, I made a poor decision, and I was wrong. For that, I have brought embarrassment on my family and friends and humiliation to myself.
“I have struggled with issues regarding alcohol for years. My present legal situation occurred after I got away from putting my sobriety first. Once again, I was wrong and make no excuses.
“I am ready to pay the price for my actions and humbly ask all of you who supported me for your forgiveness. I expect no special treatment and am prepared to receive the same punishment that anyone else would receive in this situation.
“On the other hand, I plan to continue as Commonwealth Attorney for Marshall and Calloway counties. I cherish my position as a prosecutor, and I intend to be a Commonwealth’s Attorney of which you can ultimately be proud.”
The letter follows a request for Ward’s resignation by Marshall County Circuit Court Judge Dennis Foust. In a statement issued to WPSD, Foust said, “Mike is a very good prosecutor as far as trying cases he’s top notch, there’s no question about that, but the court’s credibility is at risk.”
“I’ve got to make sure everybody gets a fair shot. The Commonwealth and the defendant,” said Foust. “And when one side is harmed by the actions of one it compromises the entire system. That’s what my greatest concern is.”
“Mike has acknowledged that he has some personal issues he has to deal with and after a lot of consideration, I have concerns as to his ability to stand before my court and fulfill his role as Commonwealth Attorney,” said Foust.
No further action on the issue has been reported.
Ward was arrested on Saturday, Feb. 16 shortly after 7 p.m.
According to police reports, Marshall County 911 received a call reporting a possible impaired driver. The caller stated that they had witnessed a vehicle “driving side to side on the roadway.” Further investigation revealed Ward as the driver.
