Calvert City councilman, attorney arrested for DUI

CALVERT CITY – Attorney and Calvert City Councilman Brad Goheen was arrested for DUI shortly before noon Thursday as he made his way back from Murray, reportedly after seeing a movie with his three-year-old daughter and her preschool class.

According to the arresting officer’s citation, a caller reported Goheen to be driving recklessly on U.S. Highway 641 and also on the Purchase Parkway, running off onto the shoulder and hitting lane barrels in the construction zone.

The citation indicates that in responding to the call, officers witnessed Goheen drifting from the passing lane to the slow lane three times.

Officers reported that upon stopping Goheen at a Shell station, he appeared “slow, with lazy speech and under the influence.”

Goheen was issued a field sobriety test, which he failed. Officers administered a Horizontal Gaze Nystagmus (HGN) Eye Test as well.

The Horizontal Gaze Nystagmus standardized field sobriety test involves the officer moving a stimulus, usually the tip of his finger, back and forth in front of the driver’s eyes to see if the driver’s eyes are jerking while following his finger.

The National Highway Traffic Safety Administration indicates that the HGN test is the most reliable of the three standardized tests (the other two being the walk-and-turn test and the one-leg stand test) in determining whether or not the driver is above the legal limit.

The officer’s citation indicates that HGN was present in the test administered to Goheen.

Officers also located two pills in the vehicle which are pending identification verification.

Goheen was charged with driving under the influence, improper lane usage, possession of a controlled substance and prescription controlled substance not in original container.

Goheen was taken to the Marshall County Detention Center where he was released on a $2,500 surety bond.

He appeared in District Court where Judge Jack Telle set his bond conditions as follows: no driving before noon on March 28, no illegal/unauthorized drug use, and no violations of the law or arrests.
Results of the blood and urine tests were not available at press time.

Goheen has publicly stated his innocence since the incident, citing his reason for swerving was due to his helping his daughter secure her seat belt.

In a television interview with News Channel 6, Goheen said “There’s no way that there’s anything that is gonna stick on this because there’s nothing there. There is nothing there. I did nothing improper, simple as that.”

He is scheduled to return to court at 9 a.m on April 18.
