MURRAY – Former Marshall-Calloway County Commonwealth Attorney Mike Ward is set to appear in court before special appointed judge Hunter B. Whitesell in Calloway County District Court of Friday.

Ward is facing his third charge of driving under the influence in 18 months time.

Last month, Ward was apprehended in the parking lot of a Sonic in Murray after callers to Murray police department reported a customer possibly intoxicated. Patrolman Ricky Starks responded to the call and upon his arrival observed Ward in the driver’s seat of the vehicle, keys in the ignition and the odor of alcohol coming from the car.

Ward was arrested on driving under the influences charges, his third offense. Ward is scheduled for arraignment at 1 p.m. on Friday.

If convicted, Ward faces a penalty of up to one year in jail, $500 to $1,000 fine, 10 days to one year of community service, one year of alcohol abuse treatment and suspension of driver’s license for up to 36 months.

In 2008, Ward was convicted of two DUI offenses within a five-month time span. He resigned from his position as Commonwealth Attorney as a result. Further stipulations of the agreement included completion of a one-year alcohol treatment program and a one year’s suspension of driving privileges.
