Luna was convicted in 2008 for the killing of Debra Hendrickson at her Marshall County home in 2007.
A state supreme court ruling last November granted Luna a retrial. Last week Luna's attorneys had asked for a change of venue to Christian County, citing media coverage as the reason.
In Foust's decision on the matter he noted that if a fair and impartial jury cannot be seated in Marshall County, the court will change the venue to Calloway County.
